Terms and conditions
Draft – to be reviewed by a chamber of commerce or lawyer before publication. This is a translation; the German version is legally binding.
1. Scope, provider
These terms apply to all orders of digital content (website templates) via this website from Lukas-Domenik Sonnenfeld, Seitenstart, Anschrift siehe Impressum, Germany (“we”). Customers may be consumers (§ 13 BGB) or businesses (§ 14 BGB). We supply the countries offered on the order page; we do not supply consumers in the United Kingdom.
2. Conclusion of the contract
The presentation of the products is not a binding offer. By clicking one of the payment buttons (“Order with obligation to pay – PayPal” or “Order with obligation to pay – card, Apple Pay, Google Pay, Klarna, SEPA & more”) you submit a binding offer to buy the product shown in the order summary. The contract is concluded when we confirm the order by email or send the download link. The contract language is German. We do not store the contract text separately; you receive the product description, order summary and these terms with the confirmation by email.
3. Prices and payment
All prices are final prices in euros. VAT exempt under § 19 of the German VAT Act (small business scheme) – no VAT is charged. There are no shipping costs. Payment is made, at your choice, via PayPal or via the payment service Stripe (Stripe Payments Europe, Ltd., Dublin) using the payment methods offered there, e.g. card, Apple Pay, Google Pay, Klarna or SEPA Direct Debit. If you pay via Stripe, you enter your payment details only on Stripe’s payment page. The purchase price is due immediately when you order.
4. Delivery
Once payment has arrived, we send a download link by email, usually on the same working day, at the latest after 2 working days. The link is valid for at least 30 days; please save the file. We will resend the link on request.
5. Right of use
You receive a simple, unlimited, non-transferable right of use for one website per template purchased. You may change the template and use it publicly for that website, also if you set it up for a client. Reselling, passing on and inclusion in template collections are not permitted. Details are in the file LIZENZ.txt.
6. Right of withdrawal
Consumers have a right of withdrawal as set out in the information on the right of withdrawal. It expires early if we have begun providing the download after you expressly consented and confirmed your knowledge of the expiry.
7. Warranty
The statutory provisions on defects in digital products apply (§§ 327 et seq. BGB). The templates work in current browsers. You are responsible for content you add yourself and for your hosting. The legal notice and privacy policy scaffolds are drafting aids, not legal advice.
8. Liability
We are liable without limitation for intent, gross negligence and injury to life, body or health. For a slightly negligent breach of essential contractual obligations, liability is limited to the typical, foreseeable damage; otherwise it is excluded for slight negligence.
9. Dispute resolution
We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
10. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods; for consumers only insofar as mandatory consumer protection provisions of the country of their habitual residence do not prevail.
